These Terms of Service (the "Terms") describe the terms and conditions under which FriLar AB (the "Company", "we", "us", or "our") provides access to and use of pouchfix.com (the "Site"), including any purchases made through the Site or communications regarding the Site (collectively, the "Services").

For purposes of these Terms, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual accessing the Services. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

 

2. General Conditions & Eligibility

You must be at least 18 years of age (or the legal age for nicotine consumption in your jurisdiction, whichever is greater) to purchase any products from this website. By using the Services, you represent that you meet these age requirements. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe these requirements are not met.

 

3. Mandatory Age Verification

FriLar AB maintains a strict age verification policy to comply with both Swedish and international regulations.

• Customer Warranty: By placing an order, you represent and warrant that you are of legal age.

• Delivery Verification: All shipments are sent via UPS with Adult Signature Required. UPS is instructed to verify the recipient’s government-issued ID upon delivery. If no adult is available to sign or if age cannot be verified, the package will be returned to us at the customer’s expense.

• Refusal of Service: We reserve the right to cancel any order if we suspect the purchaser is under the legal age or is purchasing on behalf of a minor.

 

4. Global Shipping & Import Regulations

We ship nicotine pouches globally; however, customs laws vary significantly by country.

• Importer of Record: You are the "Importer of Record." It is your sole responsibility to ensure that nicotine pouches are legal to import into your country.

• Duties and Taxes: Any import duties, VAT, or nicotine excise taxes levied by your local customs authority are the sole responsibility of the customer.

• Seizures: FriLar AB is not responsible for packages seized, destroyed, or delayed by customs due to local nicotine prohibitions or regulatory changes.

 

5. Pricing and Payment

• Prices include Swedish VAT where applicable.

• We reserve the right to adjust prices without notice due to changes in nicotine excise taxes, manufacturer pricing, or currency exchange rates.

 

6. Right of Withdrawal & Returns

• 14-Day Window: You have 14 days to cancel or return your order from the date of receipt.

• Hygiene Exception: Due to the nature of nicotine products, the right of withdrawal only applies to unopened and sealed cans. Once the seal on a nicotine pouch can is broken, it cannot be returned for hygiene and health protection reasons.

• Return Costs: The customer is responsible for return shipping costs unless the product is confirmed as defective by our support team. 

 

7. Health Warning & Product Liability 

WARNING: These products contain nicotine. Nicotine is an addictive chemical.

 

• "As-Is" Provision: FriLar AB provides products as-is from the manufacturer.

• Liability: FriLar AB is not liable for any health issues arising from the use or misuse of nicotine pouches.

• Allergens: Ingredients are declared on every product page and on the packaging; it is the customer’s responsibility to check for potential allergens before use.

 

8. Governing Law and Jurisdiction

These Terms and your use of the Services are governed by the laws of Sweden. Any disputes arising out of or in connection with these Terms shall be settled in the Swedish general courts, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
